Will: Barbara LYBARGER 1828 Londonderry Twp. Bedford Co. Pa.
In the Name of God Amen, I Barbara Lybarger of Londonderry Twp. Bedford County in the State of Pennsylvania, Being sick and weak but of sound mind, memory and understanding, praise be to God. First and considering the certainty of death and the uncertainity of the time thereof and to the end I might be better prepared to leave this world whenever it shall please God to call me hence, do therefore make and declare this my last will and testament in manner following; that is to say First and principally I command my soul into the Hands of Almighty God my creator hoping for full pardon and omission of all my sins and shall enjoy Everlasting Happiness through Jesus Christ my Savior, my body I command to the earth as the discretion of my Executors herein after named. Second, all and every sum of money which I am entitled to arrising out of the real estate should the same be sold of my said husband Henry LYBARGER dec'd is to go to the use of keeping me during my life and after my death which of the children has the trouble and care of me at my death and has the burial of my body is to be allowed for the same out of the aforesaid part which my husband Henry LYBARGER dec'd has willed to me whatever two disenterested persons shall agree upon. Third: My will is that the remainder of the aforsaid part is to be divided between my 7 sons namely: Daniel, Adam, Henry, Andrew, Peter, Anthony and Jesse. Fourth; My will is that my two daughters namely Hannah intermarried Henry Haines and Leah intermarried George LYBARGER is to have no more of my aforesaid part than the have already received and Lastly I constitute and appoint my said son Jesse LYBARGER Executor of My Last Will and testament. July the sixth, 1828. Barbara x Lybarger Her Mark Pennslyvania} Be it remembered that on the 2nd Day of October A.D. 1828 Bedford County} personally appeared before the subscriber Register for the Probate of Wills & granting Letters of Administration in & for said County Josiah MILLER, esq, one of the Subscribing witnesses to the within instrument of writing, who being duly sworn according to law doth depose and say that he was personally present and heard and saw Barbara LYBARGER the testator sign by making her mark saw her publish pronounce and declare the within instrument of writing to and for her last Will & Testament that at the time thereof the testator was of sound and disposing mind memory & understanding according to the best of this deponents Knowledge & belief & that he signed his name thereto as a witness in presence of the testatrix and at her request, & that the name thereto subscrbed of Adam Geller is the proper signature of the said Adam. Josiah Miller Sworn & Subscribed the 11 Oct, A.D. 1828 Also on the 9th day of December A.D. 1828 also appeared Adam Geller the other Subscribing witness To the within instrument of writing,. who being duly sworn according to Law, deposeth & saith that he was personally present & heard and saw the testator sign by making her mark seal publish pronounce and declare the within instrument of writing as and for her last will & testament, that at the time thereof the testatrix was of sound and disposing mind memory & understanding according to the best of this deponents knowledge and belief and that he subscribed his name thereto and witness in presenceof the testatrix and at her request and that he saw Josiah Miller subscribe hIs name thereto as the other Witness..
